Terms & billing

The terms you agree to when you buy a worksheet, take a plan, or book tutoring.

This is a draft. It has not been reviewed by a lawyer, and it is not yet the policy you are agreeing to.

Drafted so that the consumer guarantees section is right, because that is the part most often got wrong and the most expensive to get wrong. Needs a lawyer's review before launch.

Who you are dealing with

These terms are governed by the law of New South Wales.

What is for sale

  • Worksheets — digital PDFs with worked solutions, at a fixed price shown before you buy. You get access immediately after payment.
  • Tutoring — quoted for each student rather than sold at a list price, because a Year 8 catching up and a Year 12 chasing a Band 6 are not the same job. You get a written quote before anything is charged.
  • A free student account, which costs nothing and never asks for a card.

Requesting a lesson is not a purchase and does not commit you to anything. You get a quote, and you decide.

Prices, GST and receipts

  • All prices on this site are in Australian dollars and include GST.
  • You get a tax invoice by email for every payment, showing the GST component and our ABN.
  • If a price on the site is obviously wrong — a decimal point in the wrong place — we will contact you rather than hold you to it, and you can cancel for a full refund.

Your rights under the Australian Consumer Law

This is the important section, so it comes before our terms rather than after them.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those guarantees, and if anything here appears to, the guarantee wins.

  • Worksheets must match their description, be fit for purpose, and be of acceptable quality.
  • Tutoring must be provided with due care and skill, and within a reasonable time.
  • For a major failure you can choose a refund or a replacement, and compensation for any reasonably foreseeable loss.
  • For a problem that is not major, we get a reasonable opportunity to fix it — and if we do not, you can still cancel and get a refund.

We do not say "no refunds" and we do not say "all sales are final", on worksheets or on anything else. Those statements are misleading when consumer guarantees apply, which they do here.

Refunds, and how to ask for one

Email mandumagpi@gmail.com, tell us what went wrong, and include your order reference if you have it. We will respond within 5 business days.

  • If a worksheet is not what it says it is, is unusable, or you were charged twice, you get your money back. We do not ask you to argue for it.
  • If a lesson does not happen because of us, it is not charged.
  • Change of mind on a digital worksheet you have already downloaded is not something the law requires us to refund. We will still usually do it if you ask soon after buying and tell us why — it is a maths worksheet, not a mortgage.

Cancelling tutoring

  • You can stop at any time. There is no minimum term and no exit fee.
  • Tell us at least 24 hours before a booked lesson and it is not charged. Later than that, or not turning up, and the lesson may be charged, because the time was held for you.
  • If we have to cancel, we reschedule or refund, whichever you prefer.

Accounts

  • One account per person. Keep your password to yourself.
  • A student under 15 needs a parent or guardian to agree before the account works. See the privacy policy for how that runs.
  • A parent or guardian can withdraw that agreement at any time, which switches the account off.
  • Tell us promptly if you think someone else is using your account.

Using the worksheets

When you buy a worksheet you are buying it for one student to use. That includes printing it, writing on it, and keeping it forever.

  • Please do not upload our worksheets to file-sharing sites, sell them, or pass the whole library to a class.
  • A tutor or teacher who wants to use them with several students should email us. There is a sensible arrangement to be had and it is cheaper than you would guess.
  • We may suspend an account that is bulk-sharing paid material. We will contact you first, unless it is plainly deliberate.

Things we cannot promise

  • We cannot promise a particular mark, band or ATAR. Nobody honestly can. What we promise is care and skill in the teaching.
  • The site will occasionally be down for maintenance or because something broke. We will keep it brief.
  • Where the law allows us to limit our liability, we limit it to resupplying the service or refunding what you paid. Where the law does not allow that — which includes the consumer guarantees above — this sentence does not apply.

If we change these terms

We will change the date at the top, and email account holders about anything that affects what you have already paid for. Changes are not retrospective: what you bought is governed by the terms as they were when you bought it.
